Module aim (aims)

The basic premise is to present the criminal justice process as a tool for resolving interpersonal conflicts. The course will also discuss models of justice with particular emphasis on retributive and utilitarian justice. The course also aims to introduce the idea of restorative justice and its tools.

Pre-requisites in terms of knowledge, skills and social competences (where relevant)

Basic information on criminal law; preferably course of criminal substantial law, criminal procedure. Student should understand basic institutions and principles of criminal law and procedure.

Syllabus

Week 1 Introduction to the class - presentation of the concept of criminal process;
Week 2 Conflict theory in criminal law;
Week 3Justice and its understanding as a starting point for further considerations - presentation of justice concepts part 1;
Week 4 Justice and its understanding as a starting point for further deliberations - presentation of justice concepts part 2;
Week 5 Basic assumptions of retributive justice;
Week 6 Basic assumptions of utilitarian justice;
Week 7 Restorative justice as a special type of approach to punishment (restorative justice tools);
Week 8 Mediation as a tool of restorative justice
Week 9 Simulation of criminal mediation
Week 10 Presentation of models within each State with discussion
Week 11 State-by-state model presentation and discussion
Week 12 State-by-state model presentation and discussion
Week 13 State-by-state model presentation with discussion
Week 14 Presentation of de lege ferenda proposals for possible changes in the approach to conflict resolution within criminal law;
Week 15 Test and summary of classes
